TALAK KA BAYAN


HAZRAT IBN-E-UMAR-RAZIALLAHO-TA-AALA-ANHUMAse riwayat hai ki huzur- ALAYHISHSALATU-WAS-SALAM ne farmaya ki sari halal cheezo mai khudaya ta-aala ke nazdik sabse napashand cheez TALAK hai ( ABU-DAUD )

HAZRAT SHWBAAN-RAZIALLAHO-TA-AALA-ANHO – ne kaha ki hazur- ALAYHISHSALATU-WAS-SALAM ne farmaya jo awrat bagair kisi khas sabab ke shawhar se TALAK mage us par zannat ki khushbu haram hai. (TIRMIZI- ABU-DAUD)

HAZRAT MAHEMUD IBN-E-LABID-RAZIALLHO-TA-AALA-ANHO- ne farmaya ki huzur- ALAYHISHSALATU-WAS-SALAM ko khabar ki gai ki ke shaksh ne apni biwi ko 3-TALAK ekatthhe di hai. Yaha sonte hi huzur naraz hokar khade ho gaye fir farmaya kya allah ta-aala ki kitab ke shath khel kiya jata hai hala ki mai tumhare andar mauzud ho. HAZRAT AYESHA RAZIALLAHO-TA-AALA-ANHUMA- ne farmaya ki RIFA-AA KURZI ki biwi ne huzur- ALAYHISHSALATU-WAS-SALAM ke pass aakar kaha ki mai rifa-aa ke pass thhi to unhone mujhe 3-TALAK de di. Uske baad maine abdul raheman-ibn-e-jabir se nikah kar liya aur nahi hai ( YANI WHA HAMBISHTARI KI KUDRAT NAHI RAKHTE ) ho huzur ne farmaya ki tum lawt kar RIFA-AA ke pass jana chahati ho? Unho ne kaha haan, huzur ne farmaya ki tum us waqt tak unki taraf nahi lawt shakti jo jab tak ki abdul raheman tum se hambistari nahi kar le. ( BUKHARI-MUSHLIM)

KUCH YAAD RAKHNE KI BAATE

TALAK 3-tarah ki hoti hai. Razai, baeen, aur mugallza-talak razai ka matlab hai ki shawhar EDDAT ke andar raza-at kar shakta hai chahe awrat jasi ho ya na ho. Aur eddat ke baad awrat ki marzi se nikah kar sakta hai. Halal ki jarorat nahi aur TALAK BAEEN ka matlab ye hai ki awrat ki marzi se shawhar eddat ke andar nikah kar shakta hai aur eddat ke baad bhi halal ki jarorat nahi. Aur talak MUGALLZA ka matlab yaha hai ki awrat halal ke bagayer pahele shawhar ke liye jayez nahi. 

Halal ki surat yaha hai ki agar talak dene wala shawhar usse hambishtari kar chukka hai to eddat puri hone ke baad dusre se nikah kare aur yaha dusra shawhar usse hambistari bhi kare ab dusre shawhar ki maut ya talak ke baad eddat puri hone par pahele shawhar se nikah kar shakti hai. Aur agar awrat se mard ne hambistari nahi ki hai to pahele shawhar ke talak dene ke fawran baad dusre se nikah kar shakti hai isliye ki ayesi awrat ki liye eddat nahi. Hadith sharif mai halal karne wale aur halal karane wale par jo lanat ayi hai us ka matlab yaha hai ki ezaab wa qabul mai halal ki shart lagayi jaye. Aur agar ezaab wa qabul mai halal ki shart na lagaye jaye to koi harz nahi balki bhalai ki niyat se hoto sawab payega. Durre mukhtar maye raddulmuhataar jild 2 safa 559 mai hai ki halal karne wale aur halal karane wale par us surat mai lanat ki gaye hai jab ki ezaab wa qabul mai halala ki shart lagayi jaye. Jayese mard awrat se is tarah kahe ki maine-[ RAZAI, BAEEN, AUR TALAKE MUGALLAZA KI SURATE BAHAR-E-SHARIYAT WAGAYERA SE MALOM KARE ] Tumse nikah kiya is baat par ki tu pahele shawhar ke liye halal ho jaye. Lekin agar halala ki niyat dil mai ho (aur ezaab wa qabul mai halala ki shart ka charcha na aye ) to is mai koi haraz aur karahat nahi balki agar bhalai ki niyat se hoto sawab payega. 

Talak dena jayez hai lekin bala sharayi wazah ke mana hai. 

Sarayi wazah hoto talak dena mubah hai balki agar awrat shawhar ko ya dusro ko taklif deti ho ya namaz na padti ho to talak dena mushtahb hai. (BAHAR-E-SHARIAT)

Agar shawhar namard hai ya us par kisi ne jadu kar diya to ki hambistari nahi kar pata aur uske dur karne ki bhi koi surat nazar nahi ati to in surato mai talak dena wazib hai agar talak nahi dega to gunehegar hoga. (bahar-e-shariyat ba hawalaye durre mukhtar wagayera)
